NIDHI GUPTA J. (Oral) Prayer in this petition is for issuing directions to the respondents No.1 to 3 for taking action in pursuance of FIR No.89 dated 05.08.2022, under Section 306 IPC, registered at Police Station Sadar Kapurthala, District Kapurthala, against respondent No.4. Learned counsel for the State submits that in compliance of direction of co-ordinate Bench of this Court vide order dated 12.10.2023, Status Report dated 28.11.2023 by way of affidavit of Gurmit Singh, PPS, Deputy Superintendent of Police (Detective) Kapurthala (holding additional charge of Sub Division Kapurthala) on behalf of respondent Nos.1 to 3 has been filed, wherein, in paras No.12 and 13 it has been stated that in the present case on 22.06.2023 cancellation report was presented before the Court of learned Additional Chief Judicial Magistrate, Kapurthala on 17.08 2023, however, the same was returned by the said Court for further VIJAY ASIJA 2024.04.25 16.27 I attest to the accuracy and integrity of this document

It is stated that thereafter, the Senior Superintendent of Police, Kapurthala, vide order No.1132-36/Reader dated 27.10.2023 entrusted further investigation to the Superintendent of Police (Investigation), Kapurthala, who recorded the statement of the complainant (petitioner herein), gone through the facts and after reinvestigation recommended to file cancellation report in the matter. Thereafter, the cancellation report has duly been filed before the learned trial Court on 20.11.2023 and the matter is now pending before the learned Additional Chief Judicial Magistrate, Kapurthala on 26.04.2024.
Order sheets shows that none had appeared on behalf of petitioner on 28.11.2023 and on the last date of hearing i.e. 06.02.2024 proxy counsel appeared on behalf of petitioner and sought adjournment. Today none appears on behalf of petitioner. In view of the statement made by learned State counsel, as noted above and in view of the status report dated 28.11.2023, no further directions are required to be issued in the present petition. The petition is accordingly disposed of. However, it is made clear that in case anything survives, liberty is granted to the petitioner to revive the same by filing appropriate proceedings as per law within three months from today, if so advised. Pending application(s), if any, shall stands disposed of.
