The present petition has been filed under Section 439 read with Section 482 of the Code of Criminal Procedure, 1973 for grant of interim bail to the petitioner in FIR No.100 dated 08.03.2023 under Sections 323, 34, 376-D, 452 of the Indian Penal Code, 1860 (Sections 377 and 506 IPC were added later on) registered at Police Station Sampla, District Rohtak. 2.

Vide the order dated 06.10.2023 passed by the Special Judgecum-Additional Sessions Judge, Rohtak, prayer of the petitioner for grant of interim bail for 15 days was declined. However, he was allowed to attend Tehravi ceremony of his father in custody on 16.10.2023 from 12.00 p.m. (noon) to 02.00 p.m.

Learned counsel for the petitioner would contend that the Tehravi ceremony would take longer than 02 hours as allowed by the Trial Court.

In view of the above, the present petition is disposed off with a direction that the petitioner shall be taken in Police custody for attending the Tehravi ceremony of his father at village Hasangarh District Rohtak on 16.10.2023 from 09.00 am till 04.00 pm and after the said ceremony he would be taken back to District Jail, Rohtak (Sunaria) under strict security. 5.

Disposed off. Pending applications, if any, also stand disposed off.
