Seeking quashing of impugned order dated 03.11.2022 declaring the peƟƟoner as proclaimed offender in the FIR capƟoned above, the peƟƟoner has come up before this Court under SecƟon 482 CrPC.

Counsel for the peƟƟoner submits that the peƟƟoner was declared as proclaimed offender vide order dated 03.11.2022. However, during invesƟgaƟon, a report was presented by AddiƟonal Deputy Commissioner of Police, City-II, Amritsar in which cancellaƟon of case was recommended to be filed and cancelled. Counsel further submits that once the peƟƟoner has been absolved, there was no reason for the peƟƟoner to appear before the Court.

There is merit in the aforesaid contenƟon.

Given above, the impugned order dated 03.11.2022 is quashed and set aside. This order shall not be construed to be an order of bail. All pending applicaƟons, if any, stand disposed.
