ARUN MONGA, J. (ORAL) Having suffered adverse concurrent findings by both the Courts below, defendant No.1/appellant herein is in second appeal against the judgment and decree dated 30.04.2015, as upheld by learned First Appellate Court vide its judgment and decree dated 16.08.2017 whereby suit filed by the plaintiff/respondent was decreed with costs and it was held that mutation NO.704 and subsequent rights qua suit property are illegal, null and void and names of plaintiffs were recorded as coholders and defendants were restrained from alienating or transferring the suit property.

The matter was last taken up for hearing on 07.03.2022 when learned counsel for respondent caused appearance and sought time. On resumed hearing today, no one has put in appearance on behalf of appellants. It seems that appellant is not interested in pursuing instant appeal.

Dismissed in default.
