(Oral) The applicant-wife has filed the present application for seeking transfer of the petition under Section 12 of the Hindu Marriage Act i.e. DMC/531/2023, titled 'Mandeep Singh Vs. Simranjeet Kaur', filed by the respondent-husband, pending in the Family Court, Ferozepur and she seeks transfer of the same to the Court of competent jurisdiction at Moga. In pursuance of notice issued, the respondent made appearance through counsel and filed the reply.

At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis., had taken place on

19.03.2023, but no child was born from the said wedlock. Unfortunately, matrimonial dispute arose between the parties. The applicant is not having any source of earning and as such, is dependent upon her parental family. She has got lodged an FIR bearing No.99 dated 14.06.2024 under Sections 498-A, 406, 120-B of IPC, Police Station Dharamkot, District Moga and the respondent is facing trial relating to the same, in the Courts at Moga. The distance between the two places is stated to be 73 kilometres. On the other hand, counsel for the respondent submits that the respondent has filed the petition for quashing of the aforesaid FIR. Further, it is submitted that before the Mediation Centre also, the applicant has not been making appearance.

In view of aforesaid, it is pertinent to mention that so far as the quashing proceedings are concerned, there is nothing coming on record about the same, to be pending before the Court. Otherwise also, with regard to the assertions about the applicant, not making appearance before the Mediation Centre, same is not to be considered by this Court. In any case, even though, there is no child born from the said wedlock, but however, the applicant herself is not having any source of earning and is dependent upon her parental family. The respondent is facing trial in criminal case in the Courts at Moga, wherein he is required to make appearance on each and every date of hearing.

Considering the aforesaid circumstances, the transfer application is allowed and the petition under Section 12 of the Hindu Marriage Act i.e. DMC/531/2023, titled 'Mandeep Singh Vs. Simranjeet

Kaur', filed by the respondent-husband, stands transferred from the Family Court, Ferozepur, to the Court of competent jurisdiction at Moga. The requisite record of the aforesaid case be sent by the Family Court, Ferozepur, to the District and Sessions Judge, Moga.

Learned District and Sessions Judge, Moga, shall assign the said petition to the Family Court, Moga. Even, the parties are directed to appear before the Family Court, Moga, within a period of one month from today onwards.
