Respondent No.2 filed a complaint under Sections 420/120-B IPC against the petitioners and three others namely Surveen Chawla, Akshay Thakker and Manvinder Singh Chawla.

Vide order dated 03.04.2019, learned Chief Judicial Magistrate, Hoshiarpur dismissed the complaint against the petitioners, however, Surveen Chawla, Akshay Thakkar and Manvinder Singh Chawla were summoned to face trial.

The complainant preferred a revision petition wherein notice was issued to the present petitioners for 13.7.2019. Learned counsel for the petitioners has referred to order dated 01.05.2019 (P.8) passed in CRM-M-18193 of 2019 vide which this Court on the petition preferred by Surveen Chawla and others stayed the further proceedings against them on the basis of summoning order dated 03.04.2019.

The contention of learned counsel for the petitioners is that once the proceedings qua the main accused have been stayed, no useful purpose would be served by continuing the proceedings against the MANOJ KUMAR 2019.11.09 15:22 I attest to the accuracy and integrity of this document

It may not be possible to accept the contention of learned counsel. At this stage, the petitioners have only been issued notice on the revision petition filed by the complainant. However, there is no order summoning the petitioners.

The petition is thus pre mature at this stage. However, keeping in view the facts and circumstances, it is deemed appropriate to request the revisional Court to expeditiously decide the revision petition, preferably within a period of three months from today. Ordered accordingly.

Petition stands disposed of.
