Petitioner seeks transfer of petition filed under Section 9 of Hindu Marriage Act, 1955, tilted as Mithun Kumar Mehta Versus Alka Rani Kathuria, from the Court of the learned Civil Judge (Senior Division), Rajpura, (Punjab), to a Court of competent jurisdiction at Hisar (Haryana). It is stated that petitioner has got two school going children aged five and half years and eleven years and there is no male member to accompany her to Rajpura (Punjab). Keeping in view the distance between Rajpura Courts and Hisar Courts, she is unable to pursue her case at Rajpura Courts.
TA No. 451 of 2017 (O/M) -2Keeping in view the difficulty expressed by petitioner, petition filed under Section 9 of Hindu Marriage Act, 1955, tilted as Mithun Kumar Mehta Versus Alka Rani Kathuria, pending in the Court of learned Civil Judge (Senior Division), Rajpura, (Punjab), is withdrawn from the said Court and same is transferred to the Court of learned Civil Judge (Senior Division), Hisar (Haryana), who may retain the case with him or entrust the same to a Court of competent jurisdiction. Consequently, petition is allowed.
