This petition under Article 227 of the Constitution of India has assailed the order dated 28.07.2025 (Annexure P-4) vide which warrants of possession has been issued and petitioner prays that his objections filed on 11.08.2025 (Annexure P-5) be disposed of before proceeding with the execution petition. He has filed the objection petition alleging that he is owner in possession of 1/2 share of the property as he has purchased 1/2 share of the property from brother of the decree holder as per sale deed dated 01.09.2011 bearing No. 5640.

A perusal of the file shows that warrants of possession was issued by the Executing Court before any objections were filed by the petitioner and the warrants of possession is returnable by 22.08.2025 whereas the objection petition has been presented in the Court on 12.08.2025 and it was ordered that it be taken up on 22.08.2025. So ends of justice would be met by ordering that in case by 22.08.2025, the warrants of possession are not executed then the Executing Court should decide the PARVINDER SINGH 2025.08.21 17:00 I agree to specified portions of this document
