Petitioners, who have been arrayed as accused in case FIR No.226 dated 16.11.2024, registered against them at the instance of respondent No.2 for commission of offences punishable u/s 420, 406, 120-B IPC at Police Station Baghapurana, District Moga, have filed the present petition for quashing of the aforesaid FIR along with all consequential proceedings emanating therefrom, on the strength of compromise/statements (Annexures P-3 to P-5) and order dated 24.05.2025 (Annexure P-6) of National Lok Adalat.

Learned counsel for the petitioners has drawn the attention of the Court to the statement made on oath by petitioner No.1-Charanjit Singh in the Court of Civil Judge (Junior Division), Baghapurana, a bare perusal of which goes to show that the financial dispute was settled at Rs.7,73,000/- and the said amount was given by way of cheque bearing No.736233 drawn on Yes Bank. In pursuance to the said statement, statement of Mr. Sahil Goyal, who is Senior Manager of Punjab and Sind Bank (Branch Moga) has HAMANT 2025.09.01 09:30 I attest to the accuracy and integrity of this document

CRM-M-46351-2025 also been recorded, wherein it has been mentioned that as per the compromise, he (Sahil Goyal) has no objection to quash the FIR. Subsequent to the recording of the said statement,
NOC dated 17.05.2025 has also been issued by the bank authorities.

Today, learned counsel for respondent No.2-Bank also endorses the factum of compromise and he has no objection, if the FIR is quashed. 4.

In view of the fact that financial dispute has been resolved between the parties by way of compromise, their respective statements have been recorded before the learned Civil Judge (Junior Division), Baghapurana, as also the fact that bank has issued the NOC, continuation of the present FIR is nothing, but sheer abuse of process of law. 5.

The present petition is allowed and the FIR No.226 dated 16.11.2024
