Dated Police Station Sections 17.08.2023 Sadar Pehowa, Kurukshetra 406, 419, 420, 465, 467, 468, 471, 180, 120-B IPC, 1860 Seeking quashing of impugned order dated 14.05.2024 passed by Additional Sessions Court, Kurukshetra in the FIR captioned above whereby the bail of the petitioner under section 437(6) was dismissed, the petitioner has come up before this Court under Section 528 BNSS.

State counsel opposes the present petition on the ground of maintainability while submitting that once a statutory remedy is available under section 483 BNSS, the extra ordinary jurisdiction under section 528 BNSS cannot be invoked. 3.
Faced with this, counsel for the petitioner seeks to withdraw the present petition with liberty reserved to the petitioner to file a petition seeking regular bail under section 483 BNSS straightaway in this Court, if so advised. 4.
