(ORAL) The Petitioner has preferred this writ petition for the issuance of an appropriate writ in the nature of mandamus directing the respondents to consider the case of the petitioner for promotion to the post of Head Constable with effect from the date on which his batch mate/respondent No.5 was promoted and granted him all the consequential benefits arising therefrom. Learned counsel for the petitioner submits that the petitioner was promoted as EHC in the year 2016 after his initial recruitment to the post of Constable on 05.08.2004. Respondent No.5 was also recruited as Constable in the year 2004 and has been promoted to the post of Head Constable vide order dated 24.07.2017 and the case of the petitioner has POONAM BHATT 2023.03.10 15:57 I attest to the accuracy and authenticity of this Judicial Record/Decree/Document, which is scanned copy of the original
CWP No.27758 of 2022 -2not been considered for the promotion. The petitioner claims that he be also promoted to the post of Head Constable w.e.f. 24.07.2017 as there is no impediment for promotion of the petitioner to the post of Head Constable in view of consideration of the case of respondent No.6 whose name was also considered for B1 course at the age of 40 years and 83 days. At this stage, learned counsel for the petitioner submits that the petitioner would be satisfied in case his representation dated 28.07.2022 filed before the respondent No.3 is ordered to be considered and decided in accordance with law in a time bound manner.
Notice of motion.
On the asking of the Court, Ms. Palika Monga, DAG, Haryana accepts notice on behalf of the respondents No.1 to 4 and submits that the representation of the petitioner dated 28.07.2022 shall be considered in accordance with law preferably within a period of two months from the date of receipt of certified copy of this order.
