In the main petition request is for transfer of the application for setting aside the exparte decree under Section 9 of the Hindu Marriage Act (for short the Act) and further seeking transfer of petition under Section 13 of the Act,having separate cause of action. The said petition is listed for today.

In the meanwhile application bearing CM 14271-CII/2017 has been filed seeking withdrawal of the main petition with liberty to file a fresh petition on the same cause of action. The application is supported by an affidavit of the petitioner-Rani.

In view of the above, application is allowed and main petition is dismissed as withdrawn with liberty to file a fresh one on the same cause of action.
