G.S. SANDHAWALIA, J.(Oral) The present Letters Patent Appeal is directed against the interim orders dated 03.09.2024 and 24.09.2024 passed by the learned Single Judge in CWP No.19350 of 2024, whereby certain directions have been issued.

We are of the considered opinion that the learned Single Judge is seized of the matter and therefore, the present appeal is not maintainable in view of the law laid down by the Apex Court in Midnapore Peoples' Cooperative Bank Limited and others Versus Chunilal Nanda and others, (2006) 5 SCC 399.

In case the appellant-Bank is aggrieved, it would always be YAG DUTT 2024.10.04 11:53 I attest to the accuracy and authenticity of this order/judgment

LPA No.2414 of 2024 -2open for it to file an appropriate application for the difficulty being faced by it regarding the information which has to be furnished as directed by the learned Single Judge.

Learned Senior counsel has pointed out that the application bearing CM No.15103-CWP of 2024 was ordered to be heard along-with the main petition.

We have perused the said application. We do not find from the pleadings of the said application that anything concrete as such was put forth before learned Single Judge as to what were the difficulties the appellant-bank would face on the directions which have been issued by the learned Single Judge on 03.09.2024.

The present appeal is, accordingly, disposed of as not maintainable, however, with afore-said liberty to the appellant-Bank, to file a fresh application putting forth its difficulties. (G.S.
