It is stated that after marriage between the parties on 8.12.2012, they started residing together and were blessed with a male child namely Gurvinder Singh, presently aged about 5 years. On account of cruel behaviour of respondent and his family members with respect to demand of dowry applicant along with minor son of the parties had to leave the matrimonial home and started residing with her parents at Bakhora Khurd, Tehsil Moonak, District Sangrur. Her husband Jagsir Singh has filed a divorce petition against her having title 'Jagsir Singh Vs. Harpreet Kaur' pending in the Court of Additional District Judge, Fatehabad. On account of the fact that applicant is a young woman of 32 years having no source of PARVINDER SINGH 2018.12.19 15:32 I attest to the accuracy and integrity of this document Chandigarh
T.A. No. 1036 of 2018 income and no male member being there in her family to accompany her, further since she is taking care of minor son of the parties, it is difficult for her to go there from her parental village to Fatehabad covering a distance of 100 kms on one side to attend the date of hearing there meeting travelling expenses which would also be financial constraint upon her, therefore, the application be accepted.
Notice of the application was given to the respondent, who was duly served but has not opted to appear and offer a contest. I have heard learned counsel for the applicant besides going through the record.
I am of view that the application calls for acceptance, the same is accordingly allowed. The petition in question is ordered to be withdrawn from the Court of Additional District Judge, Fatehabad and transferred to the Court of District Judge, Sangrur for disposal in accordance with law. Learned District Judge, Sangrur may retain the petition on his board or assign it to any other Court of competent jurisdiction. The parties through their counsel are directed to appear in the transferee Court on 23.1.2019. Copies of orders be sent to the Court of Additional District Judge, Fatehabad as well as to the Court of District Judge, Sangrur for information and necessary compliance. (H.S.
