*** Applicant Vaishali, aged about 33 years, wife of Ravinder Pal Singh-respondent in the application, presently residing with her parents at Patiala on account of matrimonial discord with her husband is seeking transfer of petition under Section 9 of the Hindu Marriage Act, 1955 filed by her husband Ravinder Pal Singh against her having title 'Ravinder Pal Singh Vs. Vaishali' pending in the Court of Additional Civil Judge (Sr. Divn.) Sunam to the Court of competent jurisdiction at Patiala. It is contended that applicant is a young woman, working as a Teacher in a school at Village Chahar, Tehsil Sunam, District Sangrur has since been transferred to Patiala. She is to take care of minor son of the parties, who is suffering from mental ailment getting treatment from the doctor at Patiala. It is difficult for her to travel from Patiala to Sangrur covering a distance of about 70 kms on one side, as such the application be PARVINDER SINGH 2018.12.19 16:05 I attest to the accuracy and integrity of this document Chandigarh

Notice of the application was given to the respondent As per office report, respondent has been served through his counsel in the trial Court. He has not opted to appear and offer a contest. I have heard learned counsel for the applicant besides going through the record.
I am of view that the application calls for acceptance, the same is accordingly allowed. The petition in question is ordered to be withdrawn from the Court of Additional Civil Judge (Sr. Divn.) Sunam and transferred to the Court of District Judge, Patiala for disposal in accordance with law. Learned District Judge, Patiala may retain the petition on his board or assign it to any other Court of competent jurisdiction. The parties through their counsel are directed to appear in the transferee Court on 23.1.2019. Copies of orders be sent to the Court of Additional Civil Judge (Sr. Divn.) Sunam as well as to the Court of District Judge, Patiala for information and necessary compliance. (H.S.
