**** HARNARESH SINGH GILL , J. (ORAL) The petitioner is seeking regular bail in FIR No. 412 dated 18.8.2018 under Sections 147, 149, 323, 341, 307, 427, 379, 506 IPC and Section 25 of the Arms Act, 1959, registered at Police Station City Palwal, District Palwal.
Learned counsel for the petitioner submits that petitioner is in custody since 20.7.2019. He further submits that the petitioner has not been named in the FIR and the main allegations are against accused Rohit that he along with his 5-6 colleagues after stopping his motor cycle in front of the car of the complainant, attacked him with rod and iron pipe. He further submits that Rohit has been granted regular bail by this Court vide order dated 17.9.2019 passed in CRM-M-38748-2019 (Annexure P-3). This fact has not been disputed by the learned State counsel. However, it has been stated by the learned State counsel that the petitioner GURPREET SINGH 2020.01.08 17:08 I attest to the accuracy and authenticity of this document chandigarh is also involved in another case. He further submits that in the present case,
CRM-M No. 47118 of 2019 -2challan has been presented and the case is fixed for framing of charge. In the present case, the petitioner has not been named in the FIR. The main allegations are against accused Rohit who has been granted regular bail by this Court. The petitioner is in custody since 20.7.2019. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.
Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
