HARSIMRAN SINGH SETHI , J. (Oral) 1.

Present four appeals, the details of which are mentioned in the heading, involve common point of law and common set of facts, hence, they are being dealt together. For the sake of convenience, the facts are being

LPA-2643-2025 (O&M) and connected cases taken from LPA No. 2643 of 2025.

Learned counsel for the appellants argues that though, the present appeals have been filed challenging the order dated 08.03.2022 (Annexure P-4) and order dated 05.10.2021 (Annexure P-3) directing eviction of the appellants from the land measuring half of 1.23 acres situated at RHA Parade, Amabala Cantt, under the Public Premises (Eviction of Unauthorized Occupant ) Act, 1971, but the said relief is not being pressed further by the appellants.

Learned counsel for the appellants further submits that as the land in question is in the possession of the appellants from the time of their forefathers, the appellants intends to make representation for the allotment of the said land to the appellants, in case, the same is permissible under law. . 4.

Learned counsel for the appellants further submits that the appellants will be satisfied, in case the said representation of the appellants is decided by the competent authority in accordance with law by passing an appropriate speaking order in a time bound manner so that in case, the appellants can own the said land in accWordance with law, the said relief can be extended to them.

Notice of motion on the said aspect only.

On asking of the Court, Mr. Vikram Bajaj, Senior Panel Counsel for respondents -UOI appears and accepts notice on behalf of respondent - UOI. Learned counsel for the respondent- UOI submits that in case, the appellants file any such representation with the authority concerned, the same will be considered in accordance with law and an appropriate speaking

LPA-2643-2025 (O&M) and connected cases order will be passed by the authority concerned within a period of three months from the date of receipt of such representation. 7.

Learned counsel for the respondents- UOI further submits that in case, the claim of the appellants as raised in the representation is found feasible to be accepted, an appropriate order will be passed and in case the same is not feasible to be accepted, detailed reasons for rejecting the same will be mentioned in the speaking order and the said reason will also be conveyed to the appellants as well.

Learned counsel for the appellants submits that keeping in view the statement of learned counsel for the respondents-UOI, the present appeals may kindly be disposed of having been not pressed any further with liberty to the appellants to file a representation with respondents as stated herein before.

Ordered accordingly.
