(ORAL) Prayer in the writ petition is for issuing direction to respondents to consider the petitioners eligible for promotion to the post of TGT (Sanskrit) w.e.f. 08.08.2018 as claim of petitioners for promotion has wrongly been rejected orally on the ground that petitioners are not having 50% marks in B.A whereas there is no such requirement for candidates having qualification of BA/B.Sc/B.Com with 2 years diploma in elementary education.

As per averments in writ petition, petitioners have already made representation dated 29.09.2018 (Annexure P-9) and legal notice dated 30.09.2018 (Annexure P-11) to respondent No.2 but no action has been taken so far.

Without going into the merits and demerits of the claim of the petitioners, I deem it appropriate to direct respondent No.2-Director, Elementary Education, Haryana, Shiksha Sadan, Sector 5, Panchkula to consider the representation dated 29.09.2018 (Annexure P-9) and legal notice dated 30.09.2018 (Annexure P-11) within a period of two months PANKAJ KUMAR 2019.11.16 17:37 I attest to the accuracy and integrity of this document

CWP No.31844 of 2019 (O&M) -2from the date of receipt of certified copy of this order and pass a speaking order thereon, failing which respondent No.2 shall be liable to pay costs of `25,000/- to the petitioners. This condition of imposing costs is only to prevent petitioners running from pillar to post and avail remedy of contempt in case of non-compliance of directions issued by this Court.
