The petitioner through instant petition under Article 226 of the Constitution of India is seeking setting aside of communication/order dated 27.09.2023 (Annexure P-7) whereby petitioner has been directed to enhance electricity load to make its mill of 3 ton capacity. 2.

The petitioner has already executed agreement with the respondents in terms of Custom Milling Policy for KMS 2023-24. The process of allocation of paddy has already completed. The petitioner unit is working since 2002 and respondent-department in 2006 determined capacity of the petitioner unit 3 ton.

Learned State counsel, on instructions from Mr. Arihant Jain, L.A., Sangrur, submits that petitioner in the current year would be allotted paddy considering its capacity 3 ton, however, petitioner in future may be directed to comply with impugned order dated 27.09.2023 read with PARAMJIT KAUR SAINI 2023.10.13 18:33 I attest to the accuracy and authenticity of this order/judgment

instructions issued by Government with respect to load vis-a-vis installed capacity.

Counsel for the petitioner submits that petitioner in future would get electricity load as per custom milling policy. 5.
