By way of present petition filed under Section 12 of the Contempt of Courts Act, 1971, prayer has been made for initiating contempt proceedings against the respondents for willful non-compliance of the order dated 27.08.2024 passed by this Court in CWP-20660-2024. 2.

Notice of motion.

Mr. AdityaVermani, Advocate, accepts notice on behalf of respondents and informs that in case the petitioner deposits 50% of the subsequent assessed amount within one week from today, respondents shall not disconnect his electricity.

In view of the aforesaid stand taken by the respondents, learned counsel for the petitioner submits that petitioner shall make necessary deposit of 50% of the subsequent assessed amount within a perioe of one week from today and shall file statutory appeal under Section 17 of the Electricity Act, 2003 before the appellate Authority. 5.

In view of the aforesaid undertaking, learned counsel for the petitioner does not press the present petition at this stage and submits that the same be disposed of with liberty to revive the same in case needful is not done.

Ordered accordingly.

However, in case the needful is not done within the

COCP-3739-2024 aforementioned period, as per the undertaking, the petitioner would be at liberty to seek revival of the contempt petition and in that eventuility, the respondent would be liable to pay additional sum of Rs.50,000/- as costs from his own pocket in favour of the petitioner towards litigation expenses, immediately, i.e. on the first date of listing of revival application. 8.

Rule stands discharged.
