BHARDWAJ , J (ORAL) By way of the instant petition, petitioners are praying for quashing of FIR No.01 dated 11.01.2025 under Sections 309(6) of BNS (Sections 310,115,238 of BNS added later on vide DDR NO.8 dated 13.03.2025) registered at P.S Rawalpindi, District Kapurthala and all subsequent proceedings emanating therefrom on the basis of compromise dated 08.07.2025 (Annexure P.2). It is evident that the allegations levelled disclose the commission of the offence of dacoity by the petitioners. The offence of dacoity by its very nature, is a grave and heinous crime against society at large, striking at the very sense of security of law-abiding citizens and creating an atmosphere of fear & lawlessness.
Such an offence not only victimises the individuals directly affected but also undermines the rule of law and public order. I am, therefore, constrained to observe that the gravity of offence alleged is such that it shocks the conscience of the Court. In the face of such serious allegations, I am not inclined to quash the FIR merely on the ground of a remote possibility of the accused being acquitted upon trial. Faced with the above, learned counsel for the petitioners prays for withdrawal of the present petition with liberty to pursue her alternative legal remedy on merits, as per law.
