ASHWANI KUMAR MISHRA , J (ORAL) Considering the nature of order proposed to be passed, we do not deem it necessary to issue notice to the private respondents. Grievance raised in the present petition is that the State Authority as well as Pollution Control Board are permitting the private respondents to act in contravention of law by operating crusher units which has effect of adversely affecting the environmental concerns. It is also submitted that in response to a legal notice, the Authorities themselves have acknowledged the violations done by the private respondents but despite an assurance that they will take action, no concrete steps have been taken.
Learned State counsel contends that the matter shall be examined by the Pollution Control Board and appropriate decision will be taken, in accordance with law.
In this view of the matter, we dispose of the petition, directing MANOJ KUMAR 2025.08.26 22:46 I attest to the accuracy and authenticity of this order respondent No.3 to take appropriate decision on the petitioner's complaint made
CWP No.24610-2025 against the private respondents after affording an opportunity of hearing to both the parties by passing appropriate orders within a period of two months from today.
The Secretary, Mining and Geology Department shall also ensure that appropriate action, in terms of the decision of Pollution Control Board is taken, as per law.
