The present petition has been filed under Article 226 of the Constitution of India read with under section 482 Cr. P.C. praying for writ in the nature of Habeas Corpus for appointing warrant officer or issuance of direction to respondents no. 1 to 3 to produce/release the detenue Mehak BI (aged about 21 years daughter of petitioner) in court from the illegal custody of respondent no. 5, who has illegally detained her at some unknown place by using force upon her.
In compliance to order dated 20.08.2025, reply by way of an of an affidavit of Assistant Commissioner of Police, East, Ludhiana on behalf of respondent-State has been filed in Court which is taken on record and a copy thereof has been supplied to learned counsel opposite. 3.
As per reply, the detenue/victim, has filed a petition before the Court of learned Chief Judicial Magistrate, Bathinda against the Sonia Puri 2025.11.20 18:44 I attest to the accuracy and integrity of this document
-2- petitioner, his wife and one Faisal under Section 115(2), BNS, 2023 alleging that victim being a major girl aged about 20 years, was residing in a live-in relationship with Vishal Singh (respondent No.5), of her own free will and sound mind. It is further alleged that the accused persons, namely Jamil Ahmed (father), Parveen Jahan (mother), and Faisal (cousin), attempted to forcibly take her away, assaulted, abused, and gave her kick blows when she refused to accompany them, and that she was rescued by respondent No.5.

On this, learned counsel for the petitioner seeks to withdraw the present petition.

Accordingly, the present petition is dismissed as withdrawn, with aforesaid observations.
