H. S. Madaan, J. (Oral) The parties have arrived at a settlement, in terms of which it has been agreed that on payment of a sum of Rs. 3 lacs more, the spouses shall get their marriage dissolved by decree of divorce by mutual consent. Since petition under Section 13 of the Hindu Marriage Act, 1955, has been filed by Ajay Kumar against Liza @ Khushboo, which is pending in the Court of District Judge, Hoshiarpur, he would move an application therein for converting it into petition under Section 13-B of the Hindu Marriage Act, 1955, which request shall not be opposed by the respondent - wife Liza @ BANITA CHUGH 2019.02.15 15:58 I am the author of this document

TA No. 385 of 2018 -2Khushboo. The parties may request the trial Court to dispense with the compulsory waiting period of six months and the trial Court may pass appropriate order in that regard, in accordance with law. Ajay Kumar shall pay a sum of Rs. 3 lacs to Liza @ Khushboo, in the form of bank draft drawn in her favour at the time of making statement in the trial Court giving her consent for dissolution of marriage between the spouses by mutual consent. The draft would be given to her at the time of making statement, if the trial Court dispense with the compulsory waiting period of six months and if it is not so done, then at the time of making statement on second motion. The parties have agreed to remain bound by this settlement.

Parties have further agreed to withdraw the other cases filed by them against each other, before the next date of hearing fixed in the trial Court.

In view of the settlement, the present application has become infructuous and is dismissed accordingly.
