By way of this petition filed under Section 439 Cr.P.C., petitioner has prayed for grant of regular bail in case FIR No.12, dated 22.05.2023, registered at Police Station SSOC, Amritsar, under Sections 25(8), Arms Act (Act No.54 of 1959).

Allegations are that a secret information was received against the petitioner to the effect that he had formed a gang for purchasing the weapons and further selling the same. Further allegations are that one pistol and four live cartridges were recovered from his possession. 3.

It is contended by learned counsel that the petitioner has been falsely involved; that investigation of the case has already been completed; recovery has already been effected and after filing of the challan, even the charges have been framed.

Mr. R.S. Khaira, DAG, Punjab accepts notice on behalf of the respondent-State and the aforesaid contention is not refuted by him. 6.

As per custody certificate placed on record by learned State counsel, petitioner is in custody for the last 6 months and 21 days, though involved in one more case.

Having regard to the aforesaid factual position, but without commenting anything upon the merits of the case, the petitioner is admitted to regular bail and he is ordered to be released on bail on his furnishing bail bonds and surety bonds to the satisfaction of learned Trial Court concerned. 8.

Allowed.
