( )* +Prayer is for quashing of order dated 27.02.2023 whereby the petitioners have been declared as proclaimed persons in case FIR No.44 dated 11.05.2019 registered for the offences punishable under Sections 420, 120-B, IPC, 1860 at Police Station Khamano, District Fatehgarh Sahib. Counsel for the petitioners submits that before filing of challan petitioner No.1 shifted his residence to Shivjot Enclave, Kharar SAS Nagar (Mohali). Petitioner No.2 also shifted to Sector 91, SAS Nagar, Mohali whereas petitioner No.3 has been shown to be the resident of Gali No.5 however as per Aadhar Card he is a resident of street No.17. Thus the challan was presented at the back of the petitioners. In order to substantiate his plea counsel for the petitioners has relied upon Aadhar Cards of the petitioners which have been placed on record.

Counsel for the petitioners further undertakes that the petitioners will appear before the Trial Court on or before 14.12.2023.
Issue notice of motion returnable for 20.12.2023. Mr. Tarun Aggarwal, Sr. DAG, Punjab appears and accepts notice on behalf of the respondent/State. In the meantime, operation of the impugned order (Annexure P-9) shall remain in abeyance."

Today, learned counsel for the petitioner has produced order dated 14.12.2023 to demonstrate that the petitioner appeared before the trial Court and stands admitted to bail. Further, learned counsel for the petitioner submits that the petitioner undertakes to regularly appear before the trial Court.

In view of the above and the undertaking given by the petitioner to regularly appear before the trial Court, order dated 14.12.2023 has lost its sting.
