As observed in the previous order, despite service, the respondent did not make appearance on that day. Even today, none has appeared on behalf of the respondent. As such, the respondent is proceeded against ex-parte.

Counsel for the applicant heard.

Applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act, filed by respondent-husband, bearing No.HMA-77-2025, titled 'Lovepreet Singh vs. Amanjeet Kaur', pending in the Family (Camp) Court, Patti, District Tarn Taran, and she seeks transfer of the same to the Court of competent jurisdiction at Amritsar.

It is submitted that marriage between the parties to the lis, had taken place on 06.10.2021 and one daughter, born from the said wedlock, who is about 3 years old, is in the care and custody of the applicant. TA-1085-2025 -2account of matrimonial dispute, the applicant together with her daughter, is residing at her parental house and is dependent upon, as she is not having any independent source of earning. The distance between the two places is stated to be 55 kms. Also, it is submitted that in the divorce petition, the respondent-husband has falsely asserted about daughter to be 10 years old, whereas, she is 3 years old.

Considering the submission aforesaid and considering the fact of applicant together with her 3 years old female child, more particularly, when she herself is not having any source of earning and also considering the distance between the two places as well as the fact of respondent, not having come forward to resist the application, the transfer application, as such, is hereby allowed and the petition under Section 13 of the Hindu Marriage Act, filed by respondent-husband, bearing No.HMA-77-2025, titled 'Lovepreet Singh vs. Amanjeet Kaur', stands transferred from the Family (Camp) Court, Patti, District Tarn Taran, to the Court of competent jurisdiction at Amritsar. The requisite record of the aforesaid case be sent by the Family (Camp) Court, Patti, District Tarn Taran, to the District and Sessions Judge, Amritsar.

Learned District and Sessions Judge, Amritsar, shall assign the said petition to the Family Court, Amritsar. Even, the parties are directed to appear before the Family Court, Amritsar, within a period of one month from today onwards.
