The petitioner-sole proprietorship took a loan from respondent-bank for establishing Compressed Bio Gas (CBG) plant at Village Akhara, Tehsil Jagraon, District Ludhiana. Due to certain circumstances beyond the control of the petitioner, arising out of public unrest qua environmental issues, the project could not be commenced within time. The last date for completion of the project, which was initially fixed as 30.09.2024, was extended to 30.06.2025, and thereafter further extended to 30.06.2026.

Learned counsel for the petitioner states that due to continued unrest caused by the local residents, the project could not be started, and, therefore, the petitioner is unable to repay the loan and keep up to the timelines fixed by the respondent-bank for repayment of loan. As a result of which, there is a strong likelihood of the loan account being declared as NPA which is evident from email dated 13.08.2025 (Annexure P-6). 3.

Learned counsel for the respondent-Bank, who appears on advance notice and on instructions, submits that in case the petitioner makes a KAMAL GANDHI 2025.08.26 09:25 I attest to the accuracy and integrity of this document

CWP No. 24469 of 2025 representation, the same shall be taken into account by the Competent Authority of the Bank and decided, in accordance with law. 4.

Accordingly, looking to the piquant situation faced by the petitioner, it would be appropriate that the bank considers the grievance of the petitioner before proceeding ahead to declare the loan account as NPA. 5.

If the petitioner makes a representation, raising all his grievances alongwith relevant documents within a period of 15 days from today along with copy of this order, the same shall be considered and decided by the Competent Authority of the Bank, in accordance with law, and only thereafter bank would proceed further, if necessary, for declaring the loan account as NPA. $
