RAJESH BHARDWAJ, J.(ORAL) Petitioners have approached this Court praying for quashing of impugned order dated 10.05.2023, Annexure P-8, vide which learned Commissioner, Ambala Division, Ambala has ordered status qua the land in dispute in Revision No.73 titled as 'Sahab Singh and others vs Gurdev Singh and another'. It is further prayed to issue direction to learned Assistant Collector Ist Grade, Naraingarh to decide the petition under Section 4 of the Redemption of Mortgage Act filed by the petitioners expeditiously within some stipulated time period. It is also prayed to stay the operation of impugned order dated 10.05.2023, Anenxure P-8 during pendency of the present petition.
It has been contended by learned counsel for the petitioners that learned Divisional Commissioner has granted the status quo vide impugned order, dated 10.05.2023. He submits that appeal is pending for 20.12.2023. He further submits that status quo granted has prejudiced the petitioner. Notice of motion to the official respondents only at this stage.
