Prayer in this writ petition filed by the petitioner under Article 226 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondent - Department to consider the case of the petitioner in view of the order dated 19.02.2016 (Annexure P-11) and 01.06.2018 (Annexure P-10) passed by respondent - Department vide which after reconsidering the case of similar situated employee who participated in the strike, their termination orders were cancelled and their punishment of termination were converted into stoppage of three annual increments permanently, as the petitioner was also issued the charge-sheet based on the same allegation. Further a writ of certiorari has been sought for quashing/setting-aside the order dated 01.12.

2014 (Annexure P-2) vide which the services of the petitioner have been terminated and order dated 11.07.2016 (Annexure P-3) and order dated 22.03.2018 (Annexure P-4) vide which the appeals preferred by the petitioner have been dismissed. MOHD YAKUB 2024.10.

Learned counsel for the petitioner, at the very outset, confines his prayer for deciding representation dated 27.05.2023 (Annexure P-13). He submits that at this stage, petitioner would be satisfied, if the said representation is decided by passing a speaking order within a time bound frame.

Mr. Surya Kumar, AAG, Punjab, accepts notice on behalf of respondent No.1 and Mr. Lalit Goyal, Advocate for Mr. Anupam Singla, Advocate has accepted notice on behalf of respondent No.2 and 3 and have no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.2 to decide representation dated 27.05.2023 (Annexure P-13), submitted by the petitioner expeditiously, by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
