The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking directions to the respondents to re-issue him passport.

The petitioner was issued passport on 24.04.2012 which expired on 23.04.2022. Two FIRs came to be registered against the petitioner. The police after completing investigation has filed its report under Section 173 Cr.P.C. against the petitioner in FIR No.116 dated 30.08.2018, registered under Sections 447, 427, 511 of IPC, at Police Station Chabbewal.

Learned counsel for the respondents submits that charges stand framed against the petitioner in FIR No.116 dated 30.08.2018, thus, the petitioner is supposed to apply to trial Court to get re-issued his passport as per notification No.570 dated 25.08.1993 issued by Central Government. Faced with this, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to approach trial Court in terms of aforesaid notification.

Dismissed as withdrawn with liberty aforesaid. The trial Court, if petitioner files an application, shall decide the application of the petitioner in terms of aforesaid notification.
