Prayer in the instant petition filed under Section 439 of the Cr.P.C. is for interim bail for one month to the petitioner in case FIR No.161 dated 19.05.2023 under Sections 148, 149, 323, 452, 302, 506 and 120-B of the IPC, 1860 registered at Police Station, Asauda, District Jhajjar.

Status report by way of affidavit of Sh.Shubham Singh, IPS, Assistant Commissioner of Police, Badli District Jhajjar has been filed by learned State counsel on behalf of respondent No.1 in Court today. The same is taken on record subject to all just exceptions. A copy thereof has been furnished to counsel opposite.

Learned State counsel, at the outset, has drawn the attention of this Court to paragraphs 5 and 6 of the affidavit. It has been submitted by the learned POONAM RATHORE 2024.10.16 18:07 I attest to the accuracy and authenticity of this document High Court Chandigarh

CRM-M-49860-2024 -2State counsel that the wife of the petitioner has indeed been diagnosed with cholelithiasis (stone in gallbladder) and for which she has been advised only elective surgery and that too if the gallbladder gets infected or is ruptured or stone moves to CBD, it is only then she would be required to undergo emergency surgery. It has been further submitted that as per the opinion of the doctor, it is not a very serious health condition. Besides this, the mother of the petitioner is staying with his wife and is taking care of her as well as nursing her. Learned State counsel has also submitted that the petitioner has previous criminal antecedents as he is involved in one more case under the NDPS Act, registered in Delhi.

In view of the above facts and circumstances, no ground is made out to grant the concession of interim bail to the petitioner. The petition, therefore, stands dismissed.
