(ORAL) The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to issue him passport.

The petitioner was issued passport on 26.09.2013 which was vaild upto 25.09.2023. The petitioner was implicated in FIR No. 48 dated 27.05.2015 u/s 18 of NDPS Act registered at Police Station, Sadar Moga. The petitioner was convicted vide judgment dated 16.03.2018 passed by trial court. The petitioner was awarded sentence of two years besides fine of Rs.10,000/-. The petitioner preferred CRA-S-1490-SB of 2018 before this Court which vide order dated 18.05.2018 suspended sentence of the petitioner. The petitioner on 17.05.2023 has applied for re-issuance PARAMJIT KAUR SAINI 2023.10.17 17:38 I attest to the accuracy and authenticity of this order/judgment

CWP No.23546 of 2023 -2- 2023:PHHC:135052 of passport. The petitioner till date has not been issued passport on the ground of pending criminal appeal.

Counsel for State, who on advance notice is present in Court, submits that as per instructions of ASI Harbinder Singh, the petitioner was involved in one FIR and no other criminal case is pending against the petitioner.

Counsel for the respondent-UOI asserts that passport authority would dispose of application of the petitioner within 6 weeks from today. 5.

In view of the above, the petition stands disposed of with liberty to passport authority to collect any other information with respect to antecedents of the petitioner as well as documents of the petitioner prior to passing the order.
