(Oral) By way of filing the present application under Section 24 of CPC, applicant Ravinder Pal Kaur, aged about 33 years, seeks transfer of divorce petition filed by her husband Simranjeet Singh, who is respondent in the present application, having title 'Simranjeet Singh vs. Ravinder Pal Kaur', pending in the Court of Additional District Judge, Gurdaspur, to a court of competent jurisdiction, at SAS Nagar, Mohali. According to the applicant, after her marriage, differences arose between the two spouses and she alongwith two minor children of the parties, leaving the matrimonial home, came to reside with her parents, presently at village Balongi, SAS Nagar Mohali. It is difficult for her to go to Gurdaspur, to attend the dates of hearing there covering a distance of more than 230 kms on one side. T.A. No. 649 of 2018 -2resources. Therefore, the application be accepted. Notice of the application was given to the respondent. As per the office report, respondent has been served but he has not opted to put in appearance.
I have heard the submissions made by learned counsel for the applicant.
Keeping in view the contentions made in the application and submissions made by learned counsel for the applicant, I find that the application has got merit and deserves to be accepted. Therefore, the same is allowed. Petition in question pending in the court of Additional District Judge, Gurdaspur, is withdrawn from that Court and transferred to the Court of District Judge, SAS Nagar, Mohali, who may retain the case on his Board or assign it to any other Court of competent jurisdiction at that place. Parties through counsel are directed to appear there on 17.1.2019.
A copy of the order be sent to the Courts concerned, for information and necessary compliance.
