(ORAL) Learned counsel for the petitioner contends that the petitioner, who is working as a Junior Technical Assistant with the respondent on a salary of `54,917/- has been fastened with a liability of `9,00,410/- on account of issuance of chargesheets for delivery of less assured gain vide order dated 16.09.2022/30.09.2022 (Annexure P-1). The petitioner has preferred the statutory appeal along with an application of stay (Annexure P2) thereagainst under Rule 9 of the Haryana Civil Services (Punishment and Appeal) Rules, 2016 read with Regulation 15 of the HSWC (Officer and Staff) Regulation, 1994, with respondent No.1 on 21.10.2022 which has not been decided till date. He submits that in a similar petition bearing CWP26467-2019 titled as Kulwinder Singh vs.

Board of Directors, The Punjab State Cooperative Supply & Marketing Federation Ltd. and others, wherein the petitioner was also a Salesman with Markfed and recovery of `1,55,29,777/- had been directed against him, the Coordinate Bench in the revision petition pending adjudication had directed the revisional authority to SWARN JIT SINGH 2022.11.

CWP-27004-2022 decide the petition within a period of three months. The Coordinate Bench had also directed that further recovery also be stayed subject to the final order that may be passed by the revisional authority.

In view of the limited prayer of the petitioner and without expressing any opinion on the merits of the case, the petition is disposed of without issuing notice to the respondents with a direction to the appellate authority (respondent No.1) to consider and decide the appeal (Annexure P-2) in accordance with law within a period of four months from the date of receipt of certified copy of the order.

Further recovery from the petitioner shall remain stayed and would be subject to the final order that may be passed by the appellate authority.
