MADAAN Present:- Mr. Sandeep Verma, Advocate for Mr. Minderjeet Yadav, Advocate for the applicant. *** Applicant Dr. Praveen Yadav, aged about 30 years, presently residing with her parents at Rewari is seeking transfer of Petition under Section 9 of the Hindu Marriage Act, 1955 filed by her husband Vikrant Dagar-respondent against her having title 'Vikrant Dagar Vs. Dr. Praveen Yadav' pending in the Court of Additional District Judge, Narnaul, District Mahendergarh to the Court of competent jurisdiction at Rewari. According to her, after the marriage was solemnized between the parties on 25.2.2015, both of them started residing together. She gave birth to twins on 14.6.2017, however, differences cropped up between the spouses on account of demand of dowry raised by respondent and his family members and she had to leave the matrimonial home along with two children. T.A. No. 671 of 2018 petition in question against her in the Court at Narnaul. Since the applicant is a young woman, require to take care of two children, it is difficult for her to go to Narnaul covering a distance of 58 kms on one side, as such the application be accepted.
Notice of the application was given to the respondent, who was duly served but has not opted to appear and offer a contest. I have heard learned counsel for the applicant besides going through the record.
I am of view that the application calls for acceptance, the same is accordingly allowed. The petition in question is ordered to be withdrawn from the Court of Additional District Judge, Narnaul, District Mahendergarh and transferred to the Court of District Judge, Rewari for disposal in accordance with law. Learned District Judge, Rewari may retain the petition on his board or assign it to any other Court of competent jurisdiction.
The parties through their counsel are directed to appear in the transferee Court on 24.1.2019. Copies of orders be sent to the Court of Additional District Judge, Narnaul, District Mahendergarh as well as to the Court of District Judge, Rewari for information and necessary compliance. (H.S.
