MADAAN Present:- Mr. Sanjiv Kumar, Advocate for the applicant. *** Applicant Navpreet Kaur has brought the present application under Section 24 C.P.C, for transfer of petition under Section 9 of the Hindu Marriage Act filed by her husband Tarsem Singh @ Soni, who is respondent in the present application, against her having title 'Tarsem Singh @ Soni versus Navpreet Kaur' pending in the Court of Civil Judge (Sr. Divn.), Ferozepur to the Court of competent jurisdiction at Amritsar.

Interalia in the application it is contended that after matrimonial dispute between the spouses, she has been residing with her parents at Amritsar. Her husband Tarsem Singh @ Soni has filed a petition under Section 9 of the Hindu Marriage Act against her which is pending in the Court of Civil Judge (Sr. Divn.), Ferozepur. She being a young woman having no source of income with no young male member in the family to accompany her, it would be difficult for her to go to Ferozepur to attend the dates of hearing there covering a distance of more than 100 kms and spending money on account of travelling charges, as such the petition in question be transferred to the Court of competent jurisdiction at PARVINDER SINGH 2018.12.10 15:27 I attest to the accuracy and integrity of this document Chandigarh

Notice of application was given to the respondent, who as per office report has been duly served but he has not opted to appear and offer a contest. I have heard learned counsel for the applicant besides going through the record.

In view of the contentions raised in the application and submissions made by learned counsel for the applicant, I find ends of justice demand that application be accepted. The same is accordingly allowed. The petition in question is ordered to be withdrawn from the Court of Civil Judge (Sr. Divn.), Ferozepur and transferred to the Court of District Judge, Amritsar for disposal in accordance with law. Learned District Judge, Amritsar may retain the petition on his Board or assign it to any other Court of competent jurisdiction. The parties through their counsel are directed to appear in the transferee Court on 17.1.2019. Copies of orders be sent to the Court of Civil Judge (Sr. Divn.), Ferozepur as well as to the Court of District Judge, Amritsar for information and necessary compliance.
