The petitioner is seeking regular bail in FIR No.42 dated 06.03.2025, under Sections 20 and 27 of NDPS Act, 1985 registered at Police Station Nangal Chaudhary, District Mohindergarh. 2.
Learned counsel for the petitioner contended that the petitioner is in custody since 07.03.2025 and nothing has been recovered from his possession. He was nominated as an accused on the basis of disclosure statement of co-accused-Ajay Mehar from whose possession the contraband has been recovered, who has already been granted bail by a Co-ordinate Bench of this Court vide order dated 25.07.2025 in CRM-M-38707 of 2025. The case of the present petitioner is on the same footing. Learned counsel further contended that except the present case, no other case is pending against him.

CRM-M-46314-2025 -2the present one is pending against the present petitioner and nothing has been recovered from his possession, however, he opposed the bail petition by submitting that the name of the present petitioner figures in the disclosure statement of the co-accused from whose possession the contraband was recovered which is commercial quantity.

Keeping in view the contention of learned counsel for the petitioner that co-accused-Ajay Mehar has already been granted bail by a Co-ordinate Bench of this Court vide order dated 25.07.2025 in CRM-M38707 of 2025; the petitioner is nominated in this case only on the basis of disclosure statement of co-accused which is inadmissible in evidence; nothing has been recovered from his possession; he is having clean antecedents and not involved in any other case except the present one; the petitioner is in custody since 07.03.2025 i.e. for the last 05 months; investigation has already been completed; challan has been filed and there is no material on the file that he will tamper with the prosecution evidence after release as the prosecution witnesses are police officials, this Court deems it a fit case to grant him concession of regular bail. 7.
Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate concerned.
