AT CHANDIGARH T.A. No. 715 of 2018 DATE OF DECISION :- November 02, 2019 Taranjit Kaur and another ...Applicants
Versus
Rupinder Singh alias Ravinder Singh
...Respondents
CORAM:
HON'BLE MR. JUSTICE H.S. MADAAN Present:- Mr. Deepak Bhardwaj, Advocate for the applicants. Mr. G.S. Salana, Advocate for the respondents. *** This is an application for transfer of suit/petition under Sections 18 and 20 of the Hindu Adoption and Maintenance Act, 1956 titled 'Taranjit Kaur and another Vs. Rupinder Singh' pending in the Court of Civil Judge (Sr. Divn.), Sangrur to the Court of competent jurisdiction at Samana.
The application has been filed by applicant Taranjit Kaur, aged about 25 years, estranged wife of Rupinder Singh @ Ravinder Singh as well as their minor son Hargurbir Singh, aged about 1-1/2 years. Both the parties are shown to have been residing at Samana. Though respondent has opposed the request for transfer but I find that it would be convenient for both the parties to attend the dates of hearing in the Court at Samana instead of going to all the way to Sangrur in that connection. T.A. No. 715 of 2018 Accordingly, the petition in question is ordered to be withdrawn from the Court of Civil Judge (Sr. Divn.), Sangrur and transferred to Family Court at Patiala for disposal in accordance with law. The parties through their counsel are directed to appear in the transferee Court on 3.12.2019. Copies of orders be sent to the Court of Civil Judge (Sr. Divn.), Sangrur as well as to the Family Court at Patiala for information and necessary compliance.
