(ORAL) Instant is a petition under Section 482 Cr.P.C. for issuance of directions to respondent No.2 not to harass the petitioner and her other family members unnecessarily, by repeatedly calling them in the office of respondent No.4-Station House Officer, Police Station, CIA Staff, Amritsar (Rural), without complying with the provisions of Section 160 Cr.P.C., regarding foisting some false case.

Learned counsel for petitioner submits that cousin of petitioner's husband, namely, Gurpreet Singh was earlier apprehended by respondent No.4 in connection with bringing certain gold and evading tax/custom liability while travelling from Dubai to Mumbai. Despite the fact that the aforesaid issue has been sorted out by the police against the main person, the petitioner and her family members have been unduly harassed and pressurized by respondent No.4.

CRM-M-54887-2022 (O&M) 2.1 He would further canvass that no FIR has been registered against the petitioner. She and her family members are being repeatedly called by respondent No.4 without complying with the mandatory provisions of Section 160 Cr.P.C.

Learned State counsel submits that reply is yet to be filed. However, he on instructions submits that respondent No.4 would comply with the mandatory provisions of the Cr.P.C., including the provisions of Section 160 Cr.P.C., before calling petitioner, in case the petitioner is not involved in any other case.

In the premise, present petition is disposed of with a direction to the official respondents to issue a notice under Section 160 Cr.P.C. in writing before calling the petitioner for any enquiry, in case there is no FIR registered against the petitioner.
