CRM-M-54662-2022 The petitioner - Gurpreet Singh has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in FIR No.232 dated 28.10.2022 under Sections 406, 498-A IPC registered at Police Station Civil Lines Patiala.

As per the facts of the case Mamta Sharma - complainant filed a written complaint in which she alleged that she got married with Gurpreet Singh on 18.10.2020. At the time of marriage, her mother and brother had spent huge amount but even then her husband and in-laws family were unhappy with the dowry articles. She was not liked in the matrimonial home. During this period, she gave birth to a baby girl. She was ill treated by the entire in-laws family. CRM-M-54662-2022 (O&M) -2laws. They were raising demand for cash amount and other articles. Ultimately, the matter was reported to the police and the present FIR has been registered.

Learned counsel for the petitioner argued that the matter has been compromised and in pursuance of this, both the parties have filed joint petition under Section 13-B of Hindu Marriage Act. Learned counsel representing the State has filed detailed status report confirming this fact. The statement of complainant recorded by the police is Annexure R-1.

I have considered the arguments and have gone through the record carefully. The matter has been compromised. It is pointed out that the petitioner has already joined the investigation and he is not required for any other purpose. Considering the aforesaid factual position, the interim bail already granted in favour of the petitioner vide order dated 24.11.2022 is accordingly, confirmed, subject to the conditions enshrined under Section 438(2) Cr.P.C.

The petition is, accordingly, accepted.
