(Oral) Applicant-petitioner Jagmeet Kaur, estranged wife of Surjit Singh - respondent is seeking transfer of divorce petition filed by her husband Surjit Singh against her, pending in the Court of Additional District Judge, Patiala, to the Court of competent jurisdiction at Sangrur, contending that she is residing with her parents and two minor children of the parties, i.e. son namely, Ekamjeet Singh, aged about 9 years and daughter namely, Gursakhi Kaur aged about 6 years, are residing with her, studying in 4th class and 1st class respectively, in a school at Sangrur. Three cases between the parties are pending in the Courts at Sangrur. Being a lady, who is to take care BANITA CHUGH 2018.12.05 16:35 I am the author of this document

T.A. No. 919 of 2018 -2of her two minor children, it is difficult for her to travel at a distance of 60 kms from Sangrur to attend the date of hearing in the Court at Patiala. Therefore, the application be accepted. Notice of the application was given to the respondent, who has been duly served but has not opted to put in appearance to contest the application.

I have heard learned counsel for the applicant-petitioner, besides going through the record.

Keeping in view the contentions raised in the application and submissions made by the learned counsel for the applicant, I find sufficient reasons to accept the application. Accordingly the same is allowed.

Petition titled as 'Surjit Singh vs. Jagmeet Kaur;, pending in the Court of Additional District Judge, Patiala, is ordered to be withdrawn from that Court and transferred to the Court of District Judge, Sangrur, who may retain the case on his Board or assign it to any other Court of competent jurisdiction at that place. Parties through counsel are directed to appear there on 15.1.2019. A copy of the order be sent to the District and Sessions Judge, Patiala, District and Sessions Judge, Sangrur, for necessary compliance.
