(ORAL) Prayer in the writ petition is for issuing direction to respondents to consider the petitioner eligible for promotion to the post of TGT (Science) w.e.f. 18.03.2016/22.03.2016 as claim of petitioner for promotion has wrongly been rejected orally on the ground that petitioner is not having 50% marks in B.A whereas there is no such requirement for candidates having qualification of BA/B.Sc/B.Com with 2 years diploma in elementary education.

As per averments in writ petition, petitioner has already sent legal notice dated 17.09.2019 (Annexure P-4) to respondent No.2 but no action has been taken so far.

Without going into the merits and demerits of the claim of the petitioner, I deem it appropriate to direct respondent No.2-Director, Elementary Education, Haryana, Shiksha Sadan, Sector 5, Panchkula to consider the legal notice dated 17.09.2019 (Annexure P-4) within a period of two months from the date of receipt of certified copy of this order and pass a speaking order thereon, failing which respondent No.2 shall be liable PANKAJ KUMAR 2019.11.16 17:37 I attest to the accuracy and integrity of this document

CWP No.31928 of 2019 (O&M) -2to pay costs of `25,000/- to the petitioner.
