Banish Mohammad v. State Of Punjab

The present petition has been filed under Section 438 Cr.P.C., seeking anticipatory/pre-arrest bail to the petitioner in case FIR No.08 dated 10.01.2020, registered under Section 420 IPC, at Police Station Kotwali Bathinda. Counsel for the petitioner submits that dispute involved in the present case is regarding only Rs.23,489/-. Although the petitioner denies any such allegations levelled against him, however, to settle the matter, for all times to come, the petitioner is ready to pay the said amount to the complainant. The petitioner has also brought a demand draft dated 04.11.2023, for an amount of Rs.24,000/-, in the name of the complainant and the same is to be handed over to the complainant.

On the asking of this Court, Mr. Sandeep Singh, Addl. A. G. Punjab, accepts notice on behalf of the respondent-State.

In the event of arrest, the petitioner be released on interim bail, subject to his furnishing personal/surety bonds to the satisfaction of the Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438 (2) Cr.P.C.
