Status report dated 18.10.2024 in the form of an affidavit of Deputy Superintendent of Police,

 


 




District Dabwali, has been filed. The same is taken on record. Copy thereof has been supplied to learned counsel for the petitioner.

2.

After considering the rival contentions, it transpires that the recovery of the contraband not being within the purview of commercial quantity, was effected from the wife of the petitioner and the petitioner has been nominated on the basis of the disclosure statement of his wife.

Learned counsel for the petitioner contends that the petitioner is not having any other criminal antecedents.

Learned State counsel, on instructions received from ASI Madan Lal, accepts that except the disclosure statement there is no other substantive evidence against the petitioner.

Be that as it may be. Without commenting on the merits of the case, the petitioner is directed to join the investigation within seven days from today and in the event of his arrest, he is ordered to be released on interim bail on his furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. He shall also abide by conditions as envisaged under Section 482(2) of BNSS, 2023.
