The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking shifting from Armed Police Cadre to District Police Cadre.

The petitioner was recruited as Constable on 31.05.2016. He was selected under BC Category. He had scored 28 marks and his date of birth is 15.09.1992. Many candidates belonging to BC Category and younger in age, despite scoring 28 marks, were allotted District Cadre. The petitioner was senior most as per his date of birth still he was allotted PAP. He had given preference to District Police. He served legal notice dated 08.01.2024 upon respondent but to no avail. 3.

CWP-24720-2025 -2had given preference to District Cadre still he was shifted to PAP. The respondent is not acting upon his notice.

Learned State counsel submits that competent authority would consider petitioner's representation and pass an appropriate order within three months. The petitioner may be directed to produce evidence that he had given preference to District Cadre in his application form or any other document.

The respondent shall consider claim of petitioner and pass an appropriate order within three months from today. The respondent would be free to consider question of limitation. The petitioner shall submit evidence in support of his contention that he had given preference to District Police Cadre.
