(ORAL) Prayer in this petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No. 225 dated 16.11.2022 registered under Section 420 IPC at Police Station Mahilpur, District Hoshiarpur.

As per prosecution story, the aforesaid FIR was lodged at the instance of Tara Singh, wherein it is alleged that the petitioner along with her husband had defrauded him of an amount of Rs.13 lakhs while promising government jobs to the complainant as well as to two of his relatives namely Hans Raj and Ram Pal. It is alleged that while an amount of Rs.4.30 lakhs was paid in cash, an amount of Rs.1 lakh was paid by them through 'Paytm' and another amount of Rs.7.70 lakhs through cheque. However, the accused neither secured any job for them nor returned their amount.

CRM-M-54921-2022 -223.11.2022, passed by a co-ordinate Bench of this Court, the arrest of the petitioner was stayed, subject to the condition that she will deposit an amount of Rs.6.5 lakhs before the trial Court within a period of three week, failing which the interim order shall be deemed to be recalled. The petitioner had failed to comply with the order dated 23.11.2022, therefore, the interim directions protecting the arrest of the petitioner were recalled vide order dated 15.12.2022.

Since, the petitioner had failed to comply with the order dated 23.11.2022, no further orders are required to be passed in this case. Accordingly the main petition as well as all the pending criminal miscellaneous applications, are hereby dismissed.
