MANJARI NEHRU KAUL, J. (ORAL) This is a second petition under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No.182 dated 05.07.2022 under Sections 21 (B) and 29 of NDPS Act, 1985, registered at Police Station Ratia, District Fatehabad.

At the outset, learned State counsel while opposing the prayer made by the counsel opposite has submitted that there has been material concealment from this Court that the petitioner was declared a proclaimed offender on 10.08.2023 and directions had been issued to register an FIR against him under Section 174-A of the IPC. 3.

Learned counsel for the petitioner, however, has feigned ignorance about the petitioner having been declared a proclaimed offender. In the circumstances, he prays for withdrawal of the instant petition with liberty to the petitioner to surrender before the trial Court on or before 08.11.2023.
