ARVIND SINGH SANGWAN, J. (Oral) The petition is filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in the case FIR No.295 dated 15.8.2017, registered under Sections 392, 397, 412 IPC and Section 25 of the Arms Act, at Police Station Kalanaur, District Rohtak.

In pursuance of the order dated 19.11.2019, the petitioner was released on interim bail.

Learned State counsel has filed the affidavit of the Director of Prosecution, Haryana, Panchkula and as as per the affidavit, the application has been moved before the trial Court for re-examination of the witness, which has been allowed by the trial Court and the case is now fixed for 13.1.2020.

The concerned Assistant District Attorney Sunil Kumar Jangra is present in the Court and has given an explanation, which is attached with the affidavit.

CRM-M-48117-2019 -2Since corrective action has been taken by the prosecution, no further action is called for, with reference to the notice issued to the Assistant District Attorney and the proceedings are dropped. In view of the same, the present petition is allowed and the order dated 19.11.2019 is made absolute, subject to the conditions envisaged under Section 438(2) Cr.P.C.
