Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to release the retiral benefits including gratuity and all other benefits along with interest @ 18% per annum.

Learned counsel for the petitioner submits that the petitioner retired from service on attaining the age of superannuation on 29.02.2024, however death-cum-gratuity has not been released so far, although the other pensionary benefits have been released. He further submits that the petitioner has also submitted a representation dated 29.07.2024 followed by a legal notice dated 19.08.2024 (Annexure P-3) and again submitted a representation dated 05.09.2024 (Annexure P-4), however, the gratuity amount has not been released to the petitioner. CWP No.29802 of 2024 (O&M) directions are issued to respondent No.1 to consider and decide the said legal notice dated 19.08.2024 (Annexure P-3), by passing a speaking order.

Mr. M.S. Longia, Advocate, accepts notice on behalf of respondents and has no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.1 to decide the legal notice dated 19.08.2024 (Annexure P-3), submitted by the petitioner expeditiously, by passing a speaking order, preferably within a period of three months from the date of receipt of certified copy of this order.
